These Terms apply to purchases made by individual consumers. By placing an order on the website, you confirm that you have read and accepted them.
 

1. About Salon and the artworks

 
Salon presents and sells original contemporary artworks through recurring online exhibitions.
 
Each artwork offered for sale is an original, one-of-one work. Artworks are selected through Salon’s review and acquisition process before being presented to collectors.
 
Product pages provide the principal information available for each artwork, including its title, artist, year, medium, dimensions, framing information, price and other relevant details.
 
Because artworks are handmade and original objects, minor irregularities, surface variations or characteristics inherent to the artist’s materials and process are not necessarily defects.
 

2. Prices

 
Prices are displayed in euros unless otherwise indicated.
 
Salon’s standard artwork price is based on €1,100 excluding VAT, with VAT or other applicable taxes added or displayed according to the customer’s location and the applicable tax rules.
 
Before an order is placed, the customer will be shown the total amount payable, including applicable taxes and any shipping charge collected by Salon.
 
For deliveries outside the European Union, additional import VAT, customs duties, clearance charges or local taxes may be payable on arrival unless the checkout expressly states that these charges are included or that the shipment is being sent on a duties-paid basis.
 
Where such charges are not expressly included, they are the responsibility of the customer.
 

3. Placing an order

 
To purchase an artwork, the customer follows the checkout process and provides the information required to complete the order.
 
Before confirming payment, the customer has an opportunity to review the order and correct any errors.
 
An order is not finally accepted by Salon until:
 
 
payment has been successfully authorised or received; and
 
 
the availability of the artwork has been confirmed.
 
Because each artwork is unique and available only once, it is possible, although unlikely, for two customers to attempt to purchase the same artwork at approximately the same time.
 
Salon may cancel and refund an order where an artwork is no longer available because of a technical or inventory error, duplicate simultaneous purchase, obvious pricing error, payment issue or other circumstance making fulfilment impossible.
 
If this happens, Salon will notify the customer and refund any amount already paid.
 

4. Payment

 
Payment is made through the payment methods offered at checkout.
 
Payment must be completed in full before an artwork is dispatched.
 
Salon does not store full payment-card details directly. Payments are processed through the payment providers integrated into the website.
 

5. Ownership and intellectual property

 
Ownership of the physical artwork passes to the customer once payment has been completed in full and the artwork has been delivered, subject to applicable law.
 
Buying an artwork does not transfer copyright or other intellectual-property rights in the artwork.
 
Copyright remains with the artist or other relevant rights holder.
 
The customer may display and privately resell the physical artwork, but may not reproduce, commercially exploit, publish, license or create derivative reproductions of the artwork except where permitted by law or with the appropriate rights holder’s consent.
 
Photographs, text, graphics and other content appearing on the Salon website are also protected by applicable intellectual-property law.
 

6. Delivery

 
Salon ships artworks to the destinations made available at checkout.
 
Once an order has been prepared and dispatched, delivery will usually take approximately 3–5 working days, depending on the destination, customs processing and courier conditions. This is an estimate rather than a guaranteed delivery time unless Salon expressly agrees otherwise.
 
The customer will receive tracking information where available.
 
If a delay occurs, Salon will keep the customer reasonably informed.
 
The statutory rules governing delivery to consumers remain applicable. Nothing in these Terms limits the customer’s rights where Salon fails to deliver within the agreed or legally applicable timeframe.
 

7. Risk during delivery

 
Where Salon arranges delivery using its chosen carrier, the risk of loss or damage remains with Salon until the customer, or a person designated by the customer other than the carrier, physically receives the artwork.
 
If the customer independently appoints a carrier that was not proposed by Salon, risk may pass in accordance with applicable consumer law when the artwork is handed to that carrier.
 
Customers should inspect the parcel and artwork promptly after delivery and contact Salon as soon as possible if there is visible damage or a delivery problem.
 

8. Statutory 14-day right of withdrawal

 
As a consumer buying online, you generally have a statutory right to withdraw from the purchase within 14 calendar days without giving a reason.
 
The withdrawal period begins on the day you, or a third party designated by you other than the carrier, receives the artwork.
 
To exercise this right, you must clearly inform Salon of your decision to withdraw before the 14-day period expires.

You may use the model withdrawal form at the end of these Terms, although you are not required to use that exact form.
 

Returning the artwork

 
After notifying Salon of your withdrawal, you must return the artwork without undue delay and no later than 14 days after notifying us.
 
You are responsible for the direct cost of returning the artwork.
 
The artwork should be returned securely packaged and with reasonable care.
 
You may be responsible for any reduction in value caused by handling the artwork beyond what is reasonably necessary to establish its nature, characteristics and condition.
 

Refund

 
Where the statutory right of withdrawal is validly exercised, Salon will refund:
 
 
the purchase price of the artwork; and
 
 
the cost of the least expensive standard delivery option originally offered by Salon, where required by law.
 
Any additional delivery cost resulting from your choice of a more expensive delivery method does not have to be refunded.
 
Salon will make the refund without undue delay and within the statutory timeframe. Salon may withhold reimbursement until the artwork has been received back or until you provide evidence that it has been returned, whichever occurs first.
 
Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.
 

9. Salon’s additional 30-day return policy

 
In addition to your statutory 14-day withdrawal rights, Salon voluntarily allows eligible artworks to be returned for a refund for up to 30 days after delivery.
 
For returns requested after the statutory 14-day withdrawal period but within Salon’s 30-day return period:
 
 
the artwork must be returned in its original condition;
 
 
the customer is responsible for return shipping;
 
 
Salon will refund the artwork purchase price only;
 
 
the original delivery charge will not be refunded; and
 
 
any customs, duty, tax or other external costs are not refundable by Salon unless required by law.
 
Salon may refuse the additional commercial return where an artwork has been damaged, altered or otherwise materially changed after delivery.
 
This additional 30-day policy does not restrict any statutory consumer rights.
 

10. Exchange at any time

 
Salon also offers a voluntary Exchange at Any Time policy.
 
A collector may ask to return a Salon artwork for exchange after the ordinary return period has expired.
 
An exchange is conditional on Salon receiving the artwork and confirming that:
 
 
it is the authentic artwork originally supplied by Salon;
 
 
it has not been materially altered;
 
 
it is undamaged and in acceptable condition for return to Salon.
 
Once the artwork has been received and approved, Salon will issue an exchange credit equal to the original artwork purchase price, excluding shipping, duties, taxes and other external costs.
 
The credit:
 
 
may be used toward an artwork in a future Salon exhibition;
 
 
is valid for one year from the date the exchange is approved;
 
 
is not redeemable for cash;
 
 
does not include the cost of returning the original artwork; and
 
 
does not include the cost of shipping the replacement artwork.
 
The collector is responsible for both the return shipping cost and the shipping cost of the replacement artwork.
 
An artwork acquired using an exchange credit may itself later be exchanged under the same policy, subject to the conditions in force at the time.
 
The Exchange at Any Time policy is a voluntary Salon benefit and is separate from the statutory rights described elsewhere in these Terms.
 

11. Condition, authenticity and provenance

 
Salon takes reasonable steps to verify, catalogue and document each artwork before sale.
 
Each Salon artwork is supplied with the provenance and identification information applicable to that work and may include a digital provenance tag.
 
The provenance tag and related records are intended to support the artwork’s identification, authenticity and ownership history.
 
Customers should not remove, damage or interfere with a provenance tag where one has been attached to an artwork or its frame.
 

12. Legal guarantee of conformity and hidden defects

 
Salon remains responsible for the mandatory legal guarantees applicable to consumer purchases under French law.
 

Legal guarantee of conformity

 
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity where a lack of conformity appears.
 
During this period, the consumer only needs to establish the existence of the lack of conformity and not the date on which it arose.
 
The legal guarantee of conformity entitles the consumer, subject to the conditions provided by law, to repair or replacement without charge and without major inconvenience, normally within 30 days.
 
Where repair or replacement is impossible, refused, excessively delayed, causes major inconvenience, or where the defect is sufficiently serious, the consumer may in the circumstances provided by law obtain a price reduction or terminate the contract and receive a refund.
 
A consumer whose goods are repaired under the legal guarantee of conformity benefits from an extension of the guarantee in accordance with applicable law.
 
The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. This may entitle the consumer, subject to the legal conditions, to retain the artwork with a reduction in price or return it for a refund.

These statutory guarantees apply independently of Salon’s voluntary 30-day return and Exchange at Any Time policies.
 

13. Complaints

 
If you have a problem with an order, artwork, delivery, return or other aspect of your purchase, please contact:

14. Consumer mediation

 
If a consumer dispute cannot be resolved after a prior written complaint to Salon, the customer may refer the dispute free of charge to Salon’s appointed consumer mediator:

Consumer mediation is available only after the consumer has first attempted to resolve the complaint directly with Salon.
 

15. Liability

 
Salon is responsible for performing its obligations under the contract in accordance with applicable law.
 
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful, including liability arising from mandatory consumer protections.
 
Salon is not responsible for losses caused solely by circumstances outside its reasonable control where French law permits such limitation.
 
Salon is also not responsible for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was concluded, subject always to mandatory consumer law.

16. Force majeure

 
Salon will not be liable for delay or failure to perform an obligation where performance is prevented by an event qualifying as force majeure under applicable French law.
 
Where such an event materially affects an order, Salon will inform the customer as soon as reasonably possible and take appropriate steps in accordance with applicable law.
 

17. Personal data

Personal data collected in connection with orders, payments, delivery, customer service, returns and exchanges is processed in accordance with Salon’s Privacy Policy.
 
Information about cookies and tracking technologies is available in Salon’s Cookie Policy.
 

18. Changes to these Terms

 
Salon may update these Terms from time to time, including where its services, policies or legal obligations change.
 
The version applicable to a purchase is the version made available to the customer when the order is placed.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

20. Governing law and jurisdiction

These Terms and purchases made through Salon are governed by French law.
 
Where the customer is a consumer living in another country, this choice of law does not deprive the customer of any mandatory consumer protections that apply to them under the law of their country of residence.
 
Any dispute may be brought before the competent courts in accordance with applicable consumer and jurisdiction rules.
